Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using FlightDecide, you agree to these Terms of Service. If you do not agree, do not use the application.

If you use FlightDecide on behalf of a company, flight department, or other entity, you represent that you have authority to bind that entity to these terms.

2. Advisory Use Only

FlightDecide is an informational and decision-support tool for pilots. It is not an FAA-certified weather briefing service, dispatch service, flight planning system, performance calculator, air traffic service, or safety-critical system.

All scores, verdicts, summaries, and AI-generated briefings are advisory only and must be independently verified through official and current sources before flight.

3. Pilot in Command Responsibility

Under 14 CFR 91.3, the pilot in command remains solely responsible for the safe and lawful operation of the aircraft. That responsibility is not transferred to FlightDecide, its developer, or any third-party data provider.

You are solely responsible for all go/no-go decisions, preflight planning, weather review, NOTAM review, weight and balance, performance calculations, fuel planning, regulatory compliance, and operational judgment.

4. Data Sources, Availability, and Accuracy

FlightDecide relies on third-party and public data sources, including weather and aeronautical data services. Those services may be delayed, incomplete, unavailable, malformed, or inaccurate, and the application may incorrectly parse, summarize, rank, or display that data.

You must obtain and review official weather briefings, NOTAMs, airport data, and any other required operational information from authorized sources before flight.

5. Performance and Aircraft Data

Aircraft performance, fuel, weight and balance, and related outputs in FlightDecide are estimates for planning support only. They may not reflect the actual condition, equipment, supplements, loading, maintenance state, or performance of your specific aircraft.

You must verify all aircraft-specific calculations against the applicable Pilot's Operating Handbook, approved supplements, and your aircraft's actual configuration before flight.

6. AI Output Limitations

FlightDecide may generate narrative briefings and recommendations using artificial intelligence. AI output can be incomplete, misleading, outdated, overconfident, or wrong.

AI output is provided for convenience only, is not reviewed by an aviation authority, and must not be treated as an official briefing, operational clearance, or substitute for pilot judgment.

7. Subscription and Billing

Free features, usage limits, paid plans, trial offers, and subscription pricing may change from time to time. Paid subscriptions are billed by Apple through the App Store and renew automatically unless cancelled through your Apple account settings.

Refunds, billing disputes, and subscription management are handled under Apple's applicable rules and processes.

8. Acceptable Use

You may not use FlightDecide in violation of law, to interfere with the service, to reverse engineer or misuse the application, to bypass technical restrictions, or to use the service in a way that exceeds its intended purpose.

We may suspend or terminate access if we reasonably believe you have violated these terms or misused the service.

9. Disclaimers

FlightDecide is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.

We do not warrant that the service will be uninterrupted, error-free, secure, or suitable for any particular flight operation or aircraft.

10. Limitation of Liability

To the maximum extent permitted by law, FlightDecide and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss arising from your use of or reliance on the application or its outputs.

This limitation applies to claims relating to accidents, incidents, delays, diversions, enforcement actions, personal injury, death, property damage, loss of data, loss of business, and any other operational or economic harm.

11. Indemnification

You agree to defend, indemnify, and hold harmless FlightDecide and its developer from claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable legal fees, arising from your use of the application, your flight operations, your violation of these terms, or your violation of applicable law.

12. Governing Law and Updates

These terms are governed by the laws of British Columbia, Canada, excluding conflict-of-law rules. If any provision is unenforceable, the remaining provisions remain in effect.

We may update these terms from time to time. Continued use of FlightDecide after updated terms become effective constitutes acceptance of the revised terms. Questions may be sent to support@flightdecide.com.
