By downloading, installing, or using the FlightDecide mobile application ("App") or accessing any related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Service.
These Terms constitute a legally binding agreement between you and FlightDecide ("we," "us," or "our"). If you are using the App on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
FlightDecide is an informational and advisory tool designed to assist pilots in organizing and reviewing flight-relevant data. The App does not provide certified aeronautical information, official weather briefings, or FAA-approved flight planning services.
FlightDecide is NOT:
All outputs, scores, verdicts, and AI-generated briefings are informational only and should be verified against official sources before any flight decision is made.
Pursuant to 14 CFR Section 91.3, the pilot in command (PIC) of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft. Nothing in the App or Service modifies, reduces, or transfers this responsibility.
You, as the pilot in command, bear sole and complete responsibility for:
A GO verdict from FlightDecide does not authorize flight, confirm airworthiness, or substitute for any regulatory requirement. You must exercise independent judgment at all times.
The App retrieves meteorological data from aviationweather.gov and related FAA/NOAA services. While we make reasonable efforts to display this data accurately, we cannot guarantee:
Data may be delayed, incomplete, or incorrect due to factors beyond our control including network issues, government service outages, or changes in data formats.
Aircraft performance figures included in the App are derived from publicly available Pilot's Operating Handbook (POH) data and are provided for informational and planning purposes only. These figures:
Always use the actual POH for your specific aircraft registration when computing takeoff, landing, and climb performance for actual flight operations.
The App uses large language model (LLM) AI technology to generate narrative briefings and analysis. AI-generated content:
The AI model may occasionally produce outputs that are confident-sounding but factually incorrect. You must independently verify any critical information before acting on it.
Weather information provided through the App is sourced from publicly available government data services. This data is provided as-is and may not reflect current or forecast conditions at your specific location. Always obtain an official FAA weather briefing from an authorized provider before flight. Conditions can change rapidly, and the App does not provide real-time updates during flight.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLIGHTDECIDE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR SERVICE, INCLUDING BUT NOT LIMITED TO:
THIS LIMITATION APPLIES REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the maximum extent permitted by law.
THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:
You agree to indemnify, defend, and hold harmless FlightDecide and its owners, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Free Plan: The free plan provides a limited number of analyses per calendar month at no charge. FlightDecide reserves the right to modify the free plan terms with notice.
Paid Subscriptions: Paid subscriptions are billed through Apple's App Store on a monthly recurring basis. Prices are listed in the App and may vary by region.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's standard refund process. FlightDecide has no control over Apple's refund decisions.
Price Changes: We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes. Continued use after a price change takes effect constitutes acceptance of the new pricing.
You agree not to use the App or Service to:
The App, Service, and all related content, features, and functionality are and will remain the exclusive property of FlightDecide. Our trademarks, logos, and service marks may not be used without our prior written consent.
The App integrates with third-party services including our AI analysis provider, aviationweather.gov, FAA data services, and Apple services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by in-app notification. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
